North Carolina Tax Appeal and Escheat

In an effort to better serve our clients, Everett Law Firm, P. A. has expanded its practice to include three areas of practice that involve dealing with the North Carolina Department of Revenue or various County Taxing authorities.  Each area that the firm is involved in is specifically designed to assist residents and taxpayers of North Carolina.

North Carolina Property Tax Appeal
Mr. Wesley Everett, the firm’s founder, was one of the individuals who was a leader in the 2009 Orange County property tax revolt.  Orange County has been one of the most aggressive counties in trying to increase their tax base despite the realities of the economic downturn.  As the result of of the effort of Mr. Everett and others, Orange County has delayed their scheduled 2013 reappraisal to 2015 as the county understands the difficulty they face.

In 2013 the following counties in North Carolina will be conducting reappraisals for property tax purposes:  Burke County, Caldwell County, Columbus County, Currituck County, Dare County, Davie County, Forsyth, County, Greene County, Lee County, Person Country, Randolph County, Stokes County, Swain County, Washington County and Wilkes County.  All property owners in these counties should evaluate whether the appraisers have taken into account the decrease in property values and if the appraisal accurately reflect the property’s value.

Everett Law Firm, P. A. is uniquely qualified to assist North Carolina property taxpayers appeal their property taxes.  It is critical to have an advocate who can assist you in making certain the county isn’t taxing your real estate more than appropriate.  Because the reappraisals only occur every eight (8) years getting an optimal outcome has long term financial implications.  Our lawyers are knowledgeable of the process and ready to assist those who wish to appeal their property tax valuations throughout the state of North Carolina.  There are very tight time frames to appeal taxes for each tax year, so don’t delay.

In addition to the counties that are currently up for reappraisal in 2013, it is not too late for taxpayers in counties such as Mecklenburg County, Guilford County, Cabarrus County, Rowan County, Surry County and  others to appeal their prior year valuations.  Call for a FREE consultation regarding your property tax appeal.

Escheat Services
In 2012, Everett Law Firm, P. A. began the process of attempting to find unclaimed assets and return the property to the owner.  Creating a business model that is statutorily designed to impede the ability of the finder to achieve any pecuniary reward has been both frustrating and rewarding.  The good news is the firm has been able to return over $300,000 to citizens.

Aside from the questionable business incentives involved in pursuing this activity, Everett Law Firm, P. A. is committed to serving the citizens of North Carolina and will continue to try to provide this service.

Unauthorized Substance Tax
Basically, this is a Moonshiner’s Tax.  Those who have been charged with felony possession or manufacturing of marijuana, other drugs or alcohol will be presented with an “Unauthorized Substance Tax” from the North Carolina Department of Revenue.  A guy with small grow room with a few plants could easily get a tax bill of $10,000 or more.  The State is ruthless in pursuing these assets and will employ liens, wage garnishment and other techniques that make compliance compulsory.

The lawyers at Everett Law Firm, P. A. are familiar with the appeals process, custody requirements, and calibration issues.  In many instances, we are able to negotiate a resolution that saves the taxpayer significantly.  Call for a FREE Consultation if you have received a bill from the North Carolina Department of Revenue for an Unauthorized Substance Tax.
